Terms and Conditions of Betting with the TotelFootball Service

The terms and conditions below relate to betting with the TotelFootball pools betting service (“TotelFootball”). TotelFootball will be operated by TotelManager Ltd. (“TotelManager”), a company registered in Ireland under Company Number 318252 and having its principal place of business at Unit 16, KTI Centre, Killarney, Co. Kerry, Ireland. TotelManager is fully licensed to operate under Irish gaming laws.

It is important that you understand both the benefits and the limitations of TotelFootball. By opening an account or placing a bet with TotelFootball you are deemed to have read and accepted these Terms which constitute a legally binding agreement between you and TotelManager. You will also be bound by the terms of our Rules and Privacy Policy, as published on our website, which form part of these Terms and Conditions. We may amend these Terms and Conditions from time to time, and place the new version on the website.

Your continued use of the website and the TotelFootball service following our posting of any changes will constitute your acceptance of such changes. If you do not agree to any changes to these Terms, then your only remedy is to cease using the website and the TotelFootball service.

1. During the registration process, you will select a login username and a password. Under no circumstances should you divulge this information to any third party. If you lose control of the password you may lose control over your personal information and may be subject to legally binding actions taken on your behalf.
2. You are responsible for all bets placed on your account where the correct username and password combination has been provided. If you suspect that your account details may have been compromised, then it is your responsibility to change your password.
3. TotelFootball reserves the right to refuse the whole or part of any bet. TotelFootball also reserves the right to close an account without explanation. If we do close an account, then any bets already accepted will stand, if the bets were made in good faith.
4. Betting with TotelFootball may be illegal for persons in certain countries. TotelFootball does not intend that the website or retail betting service is used for betting or any other purposes by such persons. The TotelFootall website or retail betting service does not constitute an offer or invitation by TotelFootball to place a bet from a jurisdiction in which betting is illegal.
5. It is your personal responsibility to ensure that at all times you comply with all laws in any jurisdiction that apply to your use of our service. TotelFootball cannot be held responsible for any action resulting from the use of their website in jurisdictions where betting may be illegal.
6. It is your responsibility to ensure that the credit/debit card issuer permits the card to be used for gambling purposes. TotelFootball does not accept any responsibility for any action taken by a card issuer against any account holder.
7. To ensure absolute security of your financial details and to enable us to combat fraud effectively, TotelFootball may request customers to provide personal identification for a withdrawal request when funds have been deposited by credit card.
8. You must be over 18 to register and to place a bet with TotelFootball. TotelFootball reserves the right to request proof of age and identity documentation from you at any time.
9. Accounts may be opened in Pounds Sterling (GBP) and in Euros (EUR). Interest is not payable on account balances.
10. No credit is permitted. It is your responsibility to maintain sufficient funds in your account, and to stake your bets accordingly. Where a credit/debit card is used to deposit funds, such funds only become available after TotelFootball has obtained authorisation from the relevant card issuer. If the card issuer declines a transaction, all enquiries should be addressed to the card issuer concerned.
11. Betting events will be in a format similar to fantasy sports management games. You will pick a team from players in a real world competition. You decide the size of the bet stake that you wish to place. This stake is then added to the TotelFootball betting pool for the competition. Based on the performance of these players in the real world competition your team earns points. Details of the statistics which earn you points will be published in the Rules for each competition. The top 10% of managers who earn most points will win a share of the TotelFootball betting pool.
12. 80% of pool monies bet on each competition will be paid out in prize money.
13. Bets must be made on-line at the website, through a TotelFootball partner website or through a partner’s retail betting shop.
14. Bets are accepted up to the off-time of each betting event. In the event of there being a dispute over the time at which a bet was placed then the time at which it was recorded on the TotelFootball transactional log will govern the settlement.
15. All online bet requests are confirmed by the bet placed message and are instantly available to view on your account statement. Retail bets will be confirmed on receipt of a betting docket receipt. TotelFootball does not accept responsibility for any bet not confirmed in the above manner.
16. Euro is the base currency for the TotelFootball pool and payouts in other currencies may be subject to small currency conversion charges. The applicable rate for such exchanges will track those published in the current version of the Financial Times. TotelManager and its partners will undertake to ensure that currency conversion charges are reasonable.
17. You are entirely responsible for the information that you provide to TotelFootball. We are not liable for incorrect entries made by you, including data input errors with respect to the stakes on offer.
18. Player points will be calculated using data provided to us by Global Sports Media. Global Sports Media are a leading provider of data. Whilst we will take all reasonable steps to deliver accurate data, neither TotelFootball nor Global Sports Media accept any responsibility whatsoever for erroneous data and at no stage will we enter into any correspondence relating to the allocation of player points.
19. All times referred to by TotelFootball refer to GMT.
20. You expressly understand and agree that your use of the Service is solely at your own risk. The service is provided "as is" and "as available". TotelManager accepts no responsibility and shall not be liable for any consequences that are alleged to have occurred through your use, or misuse, of TotelFootball.
21. We are not liable for any indirect, economic, consequential, or incidental loss or damage whatsoever arising out of your use of TotelFootball or your inability to use TotelFootball even if TotelManager has been advised of the possibility of such loss.
22. TotelManager is not liable for any damage to your computer system or mobile phone that results from the use of TotelFootball, even if TotelManager has been advised of the possibility of such damage.
23. Your use of the Service is conditional on your acceptance that TotelManager does not warrant that:
• TotelFootball website software or retail bet placement will be uninterrupted, secure or error-free.
• Information on the website or retail betting docket will be error free.
• Any errors in TotelFootball will be corrected.
24. Any concern over a bet claim with TotelFootball should be e-mailed to us at [email protected]. Any concern over a bet claim placed with a TotelFootball partner bookmaker should be dealt addressed to the partner bookmaker first. If the matter remains unresolved, then the issue should be e-mailed to us at [email protected] We will make every effort to ensure to resolve the matter in a mutually satisfactory manner. However, should the dispute remain unresolved, then the matter may then be referred to a mutually agreed and recognised body for arbitration. Both parties agree to be bound by the final determination of this body.
25. TotelFootball reserves the right to reclaim any incorrectly transferred monies relating to incorrect settlement of bets and by accepting these terms and conditions each account holder thereby authorises TotelFootball to withdraw such monies directly from the bank accounts into which they had been paid (without requiring any other contact or authorisation with the account holder in respect of such withdrawal).
26. It is your responsibility to ensure that all the details of your bets are correct. Once the transaction has been confirmed bets placed via the internet cannot be cancelled by the customer unless done so by mutual agreement. However, TotelFootball reserves the right to void any bet or all bets:
• inadvertently accepted after the betting has closed or where the event was resolved or at a stage where the customer could have any indication of the outcome,
• made by any group of people acting in liaison in an attempt to defraud TotelFootball,
• accepted if your account does not have sufficient funds to cover the whole of the bet.
27. Any payments made under the Refer a Friend scheme shall be paid for a period of 1 year post registration of the referred member.
28. To qualify for the €50 Refer a Friend bonus, you must get 5 friends to enter your username as Referrer during registration and each referred member must place a minimum of €20 in bets.
29. From time to time TotelFootball may offer free bets or other promotional bonuses. These funds cannot be withdrawn from the customer account until such time as the conditions of the offer have been met.
30. If any provision of these Terms and Conditions shall be held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the remaining parts of these Terms and Conditions and the remainder of the affected provision shall be unaffected.
31. Legal and beneficial title to all intellectual property rights subsisting in the TotelFootball service, including, without limitation, any text, graphics, logos, photographs, audio or video materials belongs to TotelManager or, where appropriate, a third party. Nothing herein shall assign or otherwise transfer title to you.
32. You may not republish, modify or in any way commercially exploit any of the TotelFootball service or information. You may not assign, sub-license or otherwise transfer any of your rights under these Terms to a third party.
33. You may download the TotelFootball information and view it on a single PC or mobile phone and a single copy of its selected bought option can be printed out by you for personal and private use only and not for any commercial exploitation.
34. Sensitive areas of the website are protected by Secure Socket Layer (SSL), which is industry standard technology designed to validate the identity of a Web site and to create an encrypted connection for sending credit card and other personal data. We reserve the right to amend and update security procedures without notification. Notwithstanding the above security procedures, you should be aware that there are certain risks associated with Internet communications over which we have no control.
35. TotelFootball accepts no liability under the law in any jurisdiction other than Ireland. All bets made on the website, together with these terms and conditions and the site Rules, are governed by and construed in accordance with Irish law and the Courts of Ireland shall have exclusive jurisdiction to settle any disputes that arise out of or in relation to them.
